Mother Sentenced To Probation in Son’s Death

Mother Sentenced To Probation in Son’s Death

Mount Clemens, MI - Macomb County Circuit Court Judge Kathryn Viviano sentenced 26-year-old Derricka Fleming from Clinton Township who pled no contest to Involuntary Manslaughter (15 year felony) for the death of her son to two years probation. 

On Sunday, January 22, 2023, Derricka Fleming left her apartment after putting her five-year-old son, Lamar Mitchell, to bed. In the early hours of Monday, January 23, 2023, Lamar exited the apartment and was found in a nearby park. The boy was taken to a local hospital where he was pronounced dead.

"While we respect the court's decision, our office firmly believed that confinement was warranted in this tragic case. We requested incarceration to underscore the severity of the crime and to seek justice for the loss of this young life. However, the court has chosen to impose probation instead," said Macomb County Prosecutor Peter J. Lucido.
